Subdividing Land

The following regulations should be taken into consideration when applying for subdivision of an agriculturally zoned property.

Land Use Bylaw 819/96 Section 8.2.4

(a) Parcel Density A maximum of four (4) parcels per unsubdivided quarter including:
(i) two parcels of approximately 32.4 ha (80 ac.) each 
(b) Residential subdivisions will not be allowed unless: (ii) the parcel to be created shall be located on the portion of the quarter section, so as not to preclude the existing and future use of the quarter section for agricultural purposes;
(iv) the parcel has legal and physical access and a developable site; and
(d) Maximum Parcel Size - other uses
(i) single residence - 1 ha. (2.47 ac.) unless in the opinion of the Development Officer a greater area is required to include shelterbelts, buildings or other related features (additional farmland will not be compromised to accommodate a land extensive sewerage system).

Municipal Development Plan 818/96

Policy 2.3 states  The minimum parcel size of an agricultural parcel will be 80 acres more or less (32.4 hectares), except as provided for under Policies 2.6 and 2.7
Policy 2.4 states A maximum of three subdivisions will be permitted per quarter section in the Agricultural District, including subdivisions for up to two residential parcels.
Policy 2.5 states A maximum of two residential parcels will be permitted to be subdivided out of a quarter section. Only one residential parcel will be permitted per each 80 acres.
Policy 2.6 states Notwithstanding Policy 2.4, the subdivision of a parcel physically fragmented from the balance of the quarter section by a natural or permanent (registered) man-made barrier will be permitted.
Policy 2.7 states The maximum size of a residential parcel in the Agricultural District will be 2.47 acres (1.0 hectare). The municipality may exercise some degree of variance.
Policy 2.8 states No multi-lot country residential subdivision or any other incompatible use, will be permitted within the area defined by an intensive livestock operation's Minimum Separation Distance.

Checklist

The following is required in order for an application to be considered:

  • Completed application form
  • Current copy of applicable Land Title
  • Land Titles older than one year will no longer be accepted. A copy of your current Land Title is available from any Alberta Registries office.
  • Full payment of application fee payable by Cheque, Visa, Mastercard, Interac or Cash.
  • Private Sewage Disposal System - Seperation Distance Measurement Sheet If no system currently exists this is not required.
  • Sketch showing dimensions and all existing building locations
  • Applicant Authorization Form only required if acting on behalf of a registered owner.

Application Fee: for 1 lot $1,175
Additional Lots: $200 per lot
Application Amendment Fee: $250 per lot change

Multi-lot Subdivision (6 or more lots)

Application Fee: $200
Lot Fee: $600 per lot

Survey Costs

Applicants responsibility to contact an Alberta Land Surveyor after subdivion is approved. Costs are dependant on the surveyor, type of plan and number of lots being created.

Descriptive Plan

The subdivision of the parcel of land is described on a plan and only a minimal field survey is conducted. With minimal field surveying, the cost of this plan is less than a Plan of Survey. The disadvantage of a Descriptive Plan is no legal survey posts are placed to show the location of the property boundaries.

Plan of Survey

A legal field survey is conducted to sufficiently establish the boundaries of the original parcel of land; and legal survey posts are placed in the ground to establish new parcel boundaries. The costs of a Plan of Survey are considerably higher than those of a Descriptive Plan.

Single lot subdivision process can take up to six months to complete.
